Terms and Conditions

AC Works / Figarocars, located at Tesselschadestraat 22, 5216 JW, ‘s-Hertogenbosch in the Netherlands, is responsible for the services, deliveries and sales under which the general terms and conditions below apply.

 1. Deliveries and services to which these conditions apply.

This concerns all deliveries, services and sales offered by the above company both physically at the business address as well as all services and deliveries offered on location and via internet sites / webshops.

 2. Terms and conditions for customers.

All deliveries and services are made subject to the following conditions.

 New goods

All new goods are delivered under full warranty from AC Works manufacturer/supplier. New goods can always be exchanged with unused and in original packaging within 20 days of invoice/delivery date. Electronic and separately ordered parts cannot be exchanged. Ac Works guarantees that the delivered goods comply with the goods advertised and the expected quality of the goods. Ac Works is not responsible for any changes in brand names or materials applied by the manufacturer/supplier provided that the quality corresponds to the advertised and/or discussed quality. All disputes must always be submitted to the management of Ac Works as the first.

 Used goods

The used goods do not in itself guarantee unless otherwise discussed and recorded on the proof of purchase. When purchasing used goods via the webshop / site, the product is as described in the description. The condition of the used goods cannot be complained about. If there are any misunderstandings about the delivered item, AC Works decides based on a totality whether the item can be exchanged / taken back. Ac Works does its utmost to describe/describe the article as clearly as possible. Goods used cannot be exchanged unless preceded in writing and recorded on the proof of purchase. All disputes must first be submitted to the Ac Works management.

 Shipping of goods

Ac Works is never liable for breakage or other damage during transport or shipment of goods by third parties. Complaints about damage caused during transport must always do the recipient / client with the carrier / counter. Ac Works can act as a mediator. At the request of the customer/recipient, goods can be shipped insured at an additional cost.

Services and services

All technical services and repairs carried out by Ac Works are by default three months warranty granted from the invoice date, unless otherwise agreed and recorded in writing. The warranty on repairs only relates to the repair “in itself” and not to any subsequent damage(s).

Examples of follow-up damages are:
– Defective head gasket, bearing damage (e.g. due to no or too little oil)
– Damage caused by no periodic maintenance or control interval (Motor/speed gearbox oil, refrigerant, etc.)

In the case of partial repairs, the warranty is only effective on the repaired part of the vehicle and not on the other goods and parts of the vehicle. Unless otherwise agreed in writing. Failure of head gaskets is never guaranteed unless reported immediately after repair and/or delivery of the vehicle by Ac Works. Repairs with used parts only guarantee the assembly of the part or parts but not on the part used. Unless otherwise agreed. Warranty conditions are in force on all other services provided by Ac Works, which are predetermined in writing with the customer individually. All disputes must first be submitted to the Ac Works management.

 3. Restoration/refurbishments and deposits

Ac Works performs refurbish and restoration works on vehicles for customers. This work is always fully discussed in advance in consultation with the customer and described in the sales invoice. At the start of the work, Ac Works will ask for a deposit of up to 2/3 of the total amount of the invoice. This in consultation with the customer and stated on the invoice. Since most refurbish/restauration works will take longer time, a “om and near” delivery date is stated. Ac Works always has the possibility to deviate from this reasonably deviate from this if the circumstances require this. The goal will always be to provide a good job for the agreed amount.
Since the refurbish and restoration works take place on old vehicles, a full time / guarantee can never be given about the services provided. This means that Ac Works will do the maximum within the possibilities and agreed amounts to deliver the best possible performance, however, there can never be a complaint, or any responsibility statement made to Ac Works over length (in time) in which the work performed must remain in good condition. For example, the recurrence of rust formation, or technical limitations.

 4. Disputes and exclusions

Ac Works will do its utmost and will make every effort to provide correct services and goods as mentioned above. Ac Works can never be held liable for matters that are above his power or business/guarantees that are dependent on third parties. The items mentioned in these delivery / general conditions are binding for both parties – Ac Works and Client’s disputes – must always be discussed, handled and resolved first without interference from third parties between Ac Works and the client. Ac Works is not responsible and liable if the client unilaterally deviated from this.

The matters discussed in these terms and conditions are binding on all services and deliveries. For items in which these terms and conditions do not provide for Dutch law is in force.
